David A. Brodsky (J.D., Boston University School of Law, 1983; B.A. Boston University College of Liberal Arts, 1980) currently is of counsel to our firm and handles matters as diverse as business and real estate transactions, commercial litigation, and civil and criminal appeals.
Mr. Brodsky is an experienced attorney practicing with local Orange County firms for nearly 35 years.
Mr. Brodsky worked for 20 years practicing in Chester and East Meadow, New York as a sole practitioner focused on complex commercial transactions, litigation, and appeals while representing business clients including: New York real estate developer, The Klar Organization; Long Island area gas station operator, USA Petroleum Products Corp.; Orange County builder, Barleo Homes, Inc.; and EAB Mortgage Company, Inc., an affiliate of European American Bank.
In 2003, Mr. Brodsky joined Gary Greenwald & Partners, P.C., where he continued to handle civil actions and trials in New York State Supreme Court and Surrogate’s Court, the United States District Court, and local Town and Village Courts, to handle civil and criminal appeals in all New York State appellate courts, and to handle real estate and business development, sales, leasing, and planning and zoning matters.
Mr. Brodsky has represented many of the area’s largest institutional clients, including: Town of Wallkill Planning Board; Provident Bank; Brotherhood Winery; Whispering Hills Condominiums; James Young Paving; Fusco Engineering; and Phil Goldstein C.P.A., as well as many other commercial and individual clients.
At the same time, Mr. Brodsky has handled some of the more high profile litigation and appellate cases in the firms in which he has worked. Mr. Brodsky obtained a jury verdict involving defamation punitive damages for the Middletown School Superintendent and successfully had the damages judgment affirmed in Eastwood v. Hoefer, 136 A.D.3d 655 (2d Dept. 2015), a case which was covered daily by the Times Herald-Record.
Mr. Brodsky also filed the successful briefs which resulted in reduction of bail in the “Millionaire Madam” or “Monroe Madam” case, State of New York ex. rel. Greenwald ex. rel. Gristina, 96 A.D.3d 523 (1st Dept. 2012), which was covered daily by media throughout the country.
Most recently, Mr. Brodsky obtained reversal and a new trial on appeal for a client convicted of second degree manslaughter in People v. Aladdin Sanchez, 148 A.D. 3d 831 (2d Dept. 2017).
Mr. Brodsky successfully defended a multi-million dollar oil spill claim at trial in Albany Supreme Court and successfully had the judgment affirmed in State of New York v. Robin Operating Corp. in the Appellate Division: Third Department.
Mr. Brodsky’s successful appeal in Matter of Ridge, Inc. v. New York State Liquor Authority, 257 A.D.2d 625 (2d Dept. 1999), still remains one of the benchmarks for challenges to liquor license revocation and renewal proceedings.
Mr. Brodsky has successfully handled approximately 100 appeals, including the following:
= Owens v. Owens, 107 A.D.3d 1171 (3d Dept. 2013), in which he obtained modification of a Divorce judgment to increase a client’s award of equitable distribution, spousal maintenance, and legal fees by $75,000
= Baker v. Town of Wallkill, 84 A.D.3d 1134 (2d Dept. 2011), in which he obtained reversal of an Order denying dismissal and obtained dismissal of an action alleging violation of the statutory procedure for enactment of a local zoning law;
= Marino v. Bingler, 60 A.D.3d 645 (2d Dept. 2009), in which he obtained modification of an Order and reinstatement of causes of action in a $1 million personal injury action; and
= Dellafiora v. Dellafiora, 54 A.D.3d 715 (2d Dept. 2008), in which he obtained reversal and remand of a judgment which had failed to adequately secure a wife’s right to equitable distribution of marital property
